Terms of Use

Apple’s standard licence applies too. Imagik is licensed, not sold, under Apple’s Licensed Application End User License Agreement, which is incorporated into these terms. Where the two conflict on a point Apple’s agreement covers, Apple’s agreement wins.
These terms are an agreement between you and Imagik covering the Imagik iPhone app and the imagik.io website. By using Imagik you accept them. If you don’t, don’t use it.
Your account
You need an Apple ID and Sign in with Apple to use Imagik. You are responsible for what happens under your account. You must be at least 13, or the minimum age of digital consent where you live if that is higher, and old enough to enter a contract. If you are using Imagik on behalf of an organisation, you confirm you may bind it to these terms.
Credits, plans and payment
How credits work
Imagik runs on credits. A Prism look costs 1 credit per image produced; a Forge edit costs 2, 8 or 30 depending on the quality tier you chose; each reference image adds 1 credit per output. Prices are shown in the app before you spend anything, and the app is authoritative if this page falls behind.
New accounts receive 12 free credits, once per Apple ID. A paid plan grants its monthly allowance as a reset, not an addition: unspent plan credits do not roll over into the next month. Top-up credits are separate — they never expire, and they are spent only after your monthly allowance runs out.
If a job fails or you cancel it, the unspent share of its credits is refunded to your balance automatically.
Subscriptions
Lite, Plus and Pro are auto-renewing subscriptions billed through your Apple ID at the prices shown in the App Store for your region. Annual plans grant the same monthly allowance as their monthly counterparts — the discount is on the price, not the credits. A subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel it in Settings → your name → Subscriptions. Deleting the app does not cancel a subscription.
Refunds
All purchases are processed by Apple, so refunds are handled by Apple under its own policy, at reportaproblem.apple.com. We can’t issue refunds ourselves. Credits themselves — free, granted or purchased — have no cash value, cannot be transferred or exchanged for money, and are forfeited if you delete your account. Where local consumer law gives you a right we can’t exclude, that right still applies.
Price changes
We may change prices or credit costs. Changes take effect for new purchases and for subscription renewals after we tell you, and Apple will ask you to confirm a subscription price increase before it applies.
Your content, and what you may make
The images and prompts you submit stay yours. You give us only the permission we need to run the service: to store, transmit and process them, and to send them to the model providers listed in our Privacy Policy, so we can produce the output you asked for. That permission ends when we delete the content. We do not use your content to train models.
As between you and us, whatever an engine produces from your input is yours to use, including commercially, subject to these terms and to the model providers’ own usage policies. Generative models can produce similar output for different people, so we can’t promise your output is unique or that it doesn’t resemble something else.
You confirm you have the rights to everything you upload, and you agree not to use Imagik to:
- edit or generate an image of a real person without their agreement, including anything sexual, defamatory or intended to mislead about them;
- create sexual content involving minors, or any content that sexualises a minor in any way;
- produce content that harasses, threatens, or incites violence or hatred against a person or group;
- fabricate an image intended to pass as a genuine record — a fake document, a fake news photograph, fake evidence, or a fake endorsement;
- infringe someone’s copyright, trademark, privacy or publicity rights;
- break the law where you are, or the usage policies of the underlying model providers;
- work around credit limits, attestation, rate limits or any other technical restriction, or access the API by any means other than the app.
We can refuse, stop or remove a job, and suspend or close an account, where we reasonably believe these rules have been broken. Model providers also apply their own safety filters, and a request may be refused by them even when we would have allowed it.
Generated output is not a photograph
Imagik’s output is a generative approximation. It is not a record of anything that happened, and it may be inaccurate, unflattering, or plain wrong. Check anything you intend to present as real, and label it as generated where that matters. You are responsible for what you publish.
Availability
We aim to keep Imagik running, but it depends on third-party model providers and infrastructure and may be unavailable, slow, or changed without notice. We may add, alter or withdraw features, engines and presets. If a paid feature is withdrawn in a way that materially reduces what your current subscription period buys, contact us.
Disclaimers and liability
Imagik is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that output will be accurate, suitable or error-free.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to Imagik is limited to the greater of the amount you paid us in the 12 months before the claim, or 50 US dollars.
Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or fraud. If you are a consumer, you keep every right your local consumer law gives you.
Ending it
You can stop at any time: cancel your subscription with Apple and delete your account in the app. We may suspend or end your access if you break these terms, or if we stop offering the service. The sections on content rights, disclaimers, liability and governing law survive.
Apple
Apple is not a party to these terms and has no obligation to provide support for Imagik. Apple is a third-party beneficiary of these terms and may enforce them against you. Any claim that the app fails to conform to a warranty may be directed to Apple for a refund of the purchase price; beyond that, Apple has no warranty obligation for the app.
Changes to these terms
We may update these terms. We will change the date at the top, and for material changes we will tell you in the app before they take effect. Continuing to use Imagik after that means you accept the new terms.
Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, and the courts of Delaware have exclusive jurisdiction — except that if you are a consumer, you may bring proceedings in your country of residence and the mandatory law of that country continues to protect you.
